Floriday Privacy Statement

We are happy to inform you about the personal data that we collect when using the digital platform Floriday, the manner in which we use this information and your rights regarding this data.

2. Definitions

Controllers: the above-mentioned controllers Royal FloraHolland and FloraXchange.

 

3. Data collected and processing objectives

The Controllers will be processing your personal data because you have made use of their services and/or because you provided the Controllers with this data.

The personal data processed by the Controllers consists of: your name, address, email address, telephone number, website, account password, photographs (if applicable), etc.

The Controllers process the personal data for the purpose of efficient and effective business operations, particularly in the context of carrying out the following activities:

  • The Controllers will use the information about you, such as your name and contact details, when you conclude an agreement with them as grower, supplier or buyer, or when they need to contact you. For example, the Controllers require your personal data in order to give you access to the digital platform Floriday and to make possible various actions (including legal actions), such as transactions and/or agreements that are established via Floriday, along with the associated logistical activities and financial settlements, and to implement these actions. The Controllers also use your personal data when answering your customers' questions.
  • The Controllers may use your data for public relations, business relations or marketing. Thus, the Controllers may send you newsletters with more information about their products and services. You may of course lodge a complaint or withdraw your consent if you do not wish to receive this information and/or these offers.
  • The Controllers may use your data for executing internal business operations, internal administration and management reporting, in order to improve the Controllers' products and services and to help management take better decisions.
  • The Controllers may process your data in compliance with laws and regulations.

 

4. Disclosure to third parties

It is sometimes necessary to share data with other organisations. Thus, for example, the Controllers collaborate with IT chain partners. In addition, the Controllers have also subcontracted certain work activities. Thus, for example, a third party manages the website and the Controllers make use of logistical and financial partners when executing and settling transactions via Floriday. Moreover, the Controllers are occasionally required to disclose data on the grounds of legal obligations. An example would be government criminal investigations.

In order to ensure that your data is secure, the Controllers conclude processing agreements with their partners. This means that these partners must also work according to the GDPR, and data exchange is carried out with these parties in a secure manner.

When the Controllers share personal data with organisations in countries outside the European Economic Area (EEA), they always take the necessary measures to safeguard this data. In doing so, the Controllers rely inter alia on the EU's model provisions. Where applicable, they use standard provisions in agreements with service providers in order to ensure that the transfer of personal data to parties outside the EEA meets GDPR standards.

 

5. Retention period

The Controllers will not retain your personal data longer than is necessary for the purposes for which it has been collected and thereafter processed. The Controllers duly observe the legal retention periods. Thus, they retain transaction data for the Dutch Tax and Customs Administration for a minimum of 7 years after use of the Floriday platform has been terminated. After this period, data will be deleted or anonymised.

 

6. You rights in respect of your personal data:

You have the right to request that the Controllers:

  • allow you to review your personal data;
  • correct incorrect personal data and supplement incomplete personal data;
  • delete personal data (under certain conditions);
  • restrict processing of your personal data (under certain conditions).

 

You also have the right:

  • to data portability (under certain conditions);
  • to object to data processing (under certain conditions);
  • to withdraw your consent at any time, without this infringing the legality of processing based on consent given before consent was withdrawn;
  • to submit a complaint to the Dutch Data Protection Authority.

The Controllers do not make use of automated decision making when serving you.

 

7. Security

The Controllers have taken appropriate technical and organisational measures to prevent abuse, loss, unauthorised access or other undesired actions involving your personal data.

With regard to all data entrusted to Royal FloraHolland, you, as user of Floriday or Royal FloraHolland respectively, have or should have access to your own data at all times. The Controllers use cookies on the digital platform Floriday. For more information about the use of cookies, we refer you to the Cookie Statement.

 

9. Third-party websites

The digital platform Floriday may refer users (for example by means of a hyperlink, banner or button) to other websites that are related to a specific aspect of Floriday. This does not automatically mean that the Controllers are connected with these other websites or the owners thereof. It may well be that a different privacy statement applies to these third-party websites. The present Privacy Statement is only relevant to the personal data obtained by the Controllers. The Controllers do not accept any responsibility or liability for third-party websites, or for the processing and/or contents thereof.

 

10. Changes to this Privacy Statement

The Controllers reserve the right to make changes to this Privacy Statement. Any changes will be published on this page. The Controllers advise you to consult this Privacy Statement regularly so that you are always properly informed about the contents of the currently applicable statement.
